General Terms and Conditions of Sale

I. THE GITE and MAISON BLANCHE SERVICES

These conditions are related to the short term rental of the “Gîte – La Maison Blanche”.

II. DURATION OF THE STAY

The client may not under any circumstances claim any right to remain in the premises at the end of the period of stay.

III. RESPONSIBILITY

The service “Gîte La Maison Blanche” which offers services to a client is the sole interlocutor of this client, and is responsible to him for the execution of the obligations arising from the present conditions of sale. It cannot be held responsible for fortuitous events, cases of force majeure or for the actions of any person unrelated to the organisation and running of the holiday and the services provided on this occasion.

IV. RESERVATION

The reservation becomes firm when it is paid in full, at the latest 45 days before arrival.

V. NO RIGHT OF WITHDRAWAL

Reservations are made via online booking platforms or directly with the hotel management, the tenant does not benefit from the withdrawal period.

VI. PAYMENT OF THE AMOUNT

The client formally undertakes to pay the entire amount due to the “Gîte – La Maison Blanche” service. Thus, the full payment will be required at the latest 45 days before the arrival. In the event of additional costs, these will be deducted from the deposit.

VII. PROOF OF PAYMENT

Upon receipt of the balance of the stay, the “Gîte La Maison Blanche” service will send the client a receipt.

VIII. ANIMALS

Animals are accepted on request.

IX. ARRIVAL

The client must arrive on the specified day and at the times mentioned on the contract or an acknowledgement of receipt. If this is not possible, the client must inform the “Gîte – La Maison Blanche” service. In the event of late arrival or last minute impediment, the client must inform the service provider directly. The services not consumed due to this delay will not give rise to any reimbursement.

X. CANCELLATION BY THE CLIENT

All cancellations must be notified to the “Gîte – La Maison Blanche” service by registered letter or by e-mail. The amount that will be reimbursed by the reservation service, with the exception of the booking fee, will be as follows:
– If the cancellation is made more than 42 days before the start of the stay, the 30% deposit is retained.
– If the cancellation occurs between the 42nd day (included) and the 28th day (excluded) before the start of the stay: 40% of the rent.
– If the cancellation is made between the 28th day (included) and the 2nd day (excluded) before the start of the stay: 10% of the rent.
– If the cancellation is made on or after the 2nd day (inclusive) before the start of the stay: 0% of the total rental price.

XI. INTERRUPTION OF THE STAY

In case of interruption of the stay by the client, no refund will be made.

XII. CANCELLATION BY THE LESSOR

When the “Gîte – La Maison Blanche” cancels the stay before the beginning of the stay, it must inform the hirer by registered letter with acknowledgement of receipt or by e-mail. The tenant will be reimbursed immediately and without penalty of the amounts paid.

XIII. MODIFICATION OF A SUBSTANTIAL ELEMENT

When, before the scheduled date of the beginning of the stay, “Gîte – La Maison Blanche” is obliged to make a modification to one of the essential elements of the contract, the hirer may, without contravening the previous articles, and after having been informed by the lessor by registered letter with acknowledgement of receipt or by e-mail :
– Either terminate the contract and obtain immediate reimbursement of the sums paid without penalty.
– Or accept the modification or substitution of the accommodation or activities proposed by the lessor: an amendment to the contract specifying the modifications made is then signed by the parties.
Any reduction in price will be deducted from any sums still owed by the hirer and if the payment already made by the latter exceeds the price of the modified service, the excess will be returned to the hirer before the start of his stay.
Failure by the hirer to provide the services provided for in the contract during the stay: if during the stay, the hirer is unable to provide a major part of the services provided for in the contract, representing a significant percentage of the price paid by the hirer, “Gîte – La Maison Blanche” will offer a stay in replacement of the one provided for, possibly bearing any additional cost.
If the lessor is unable to offer a replacement stay or if this is refused by the tenant for valid reasons, the former will pay the latter an indemnity calculated on the same basis as in the case of cancellation by the lessor.

XIV. CAPACITY

The contract is established for a maximum number of persons. If this number is exceeded, the provider reserves the right to refuse additional clients. Any modification or breach of the contract will be considered at the client’s initiative, the sales price will remain with the booking service.

XV. INSURANCE

The client is responsible for all damage caused by him. He is obliged to be insured by an insurance contract for these different risks. This contract is known as a holiday contract in the particular case of furnished tourist accommodation.”

A list of all the elements considered to be functional and without defects in the gîte at the time of rental is made available to the client who has 4 hours to report any defects on arrival. This list is the only reference in the event of a dispute concerning the state of the property. The tenant is obliged to use the rented property with due care.
The state of cleanliness of the gîte on the tenant’s arrival must be noted in the inventory of fixtures. The cleaning fee covers the basic cleaning of the premises. The cleaning of the premises is the responsibility of the Tenant during the rental period and before departure.

XVII. SECURITY DEPOSIT

The lessor will ask for a security deposit via the internet beforehand, the amount of which is indicated on the description sheet. After the inventory of fixtures at the end of the rental period has been drawn up, this deposit is returned, less the cost of repairing the premises if any damage is found.
In the event of early departure (before the times mentioned on the description sheet) preventing the inventory of fixtures from being drawn up on the same day as the tenant’s departure, the security deposit, subject to any damage, is returned by the lessor within a period not exceeding one week.

XVIII. DISPUTES

Any complaint relating to the state of the premises and/or the state of the description of the place of stay, must be submitted to the lessor within 4 hours of entering the premises. Any other complaint must be addressed to him as soon as possible, by letter or e-mail.
Only the courts of Namur are competent.
